Intellectual Property Policy

At 89Prints, we respect the creative rights of others and expect our community to do the same. If you believe that your intellectual property has been used on our website without authorization, please contact us by submitting a ticket following the process below.

A. Reporting an Intellectual Property Violation

Our policy is to:

  1. Remove or restrict access to any material that, in good faith, we believe infringes someone else’s intellectual property rights; and

  2. Suspend or terminate services to repeat offenders.

If you think that any content on our website violates your copyright or other intellectual property rights, please send a detailed notice to our Designated Agent that includes:

  • Description of the work you believe has been infringed (include registration numbers if applicable);

  • Details of the specific content you believe is infringing, including (a) how it violates your rights and (b) where it appears on our website (please include a direct link or clear description);

  • Your contact information: full name, mailing address, phone number, and email;

  • A statement of good faith that you believe the use of the material is not authorized by the rights owner, its agent, or the law;

  • A declaration under penalty of perjury confirming that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf; and

  • Your electronic or physical signature.

B. After Receiving a Valid Infringement Notice

Once a proper notice is received, 89Prints will review the claim and, when appropriate, remove or disable access to the allegedly infringing content.

C. Submitting a Counter-Notice

If you believe that content removed (or disabled) by mistake is not infringing, or that you have legal permission to use it (e.g., from the rights holder or under fair use), you may file a counter-notice. Your counter-notice must include:

  • Identification of the material that was removed or disabled, including where it appeared before;

  • A statement under penalty of perjury that you believe the content was removed in error or due to misidentification;

  • Your contact details: full name, address, phone number, and email;

  • A statement of consent to the jurisdiction of the Federal Court for your district; and

  • Your electronic or physical signature.

When we receive a valid counter-notice, 89Prints may forward a copy to the original complainant to inform them that the content may be restored within 10 business days. Unless the rights owner initiates legal action, the removed content may be reinstated within 10–14 business days (or more, at our discretion).

Please note that, under Section 512(f) of the DMCA, anyone who knowingly submits a false claim of infringement may be held liable for damages, including attorney’s fees.
